How Much Does It Cost to Get a Trademark? (Price Guide)

Updated  1 source

Application fee per class

$350

Registering a trademark with the U.S. Patent and Trademark Office (USPTO) costs a fixed government fee for each class of goods or services you list. A name used only for clothing is one class. The same name used for clothing and for a retail store is two classes, and the fee doubles.

All fees on this page come from one official source, the USPTO fee schedule, and we checked them on Oct 11, 2026. The USPTO revises its fees from time to time, so confirm the current amounts on uspto.gov before you file. This page lists government filing fees only; for advice on your specific mark, consult a licensed trademark attorney.

Trademark Application Fees per Class

Every application pays the base fee for each class. Surcharges are added when the application is missing required information, when you write your own description of goods and services instead of choosing entries from the USPTO's ID Manual, or when that custom description runs long.

Application fees (per class)

Item Price
Base application (Sections 1 and 44), per class $350
Base application, paper filed, per class $850
Insufficient information, per class $100
Free-form text box instead of ID Manual, per class $200
Each additional 1,000 characters in free-form text box, per class $200

How the Surcharges Work

  • Insufficient information: $100 per class if the application lacks certain required details at filing.
  • Free-form text: $200 per class if you type your own description instead of using pre-approved ID Manual entries.
  • Long descriptions: another $200 per class for each additional 1,000 characters in that free-form box.

The cheapest route is a complete electronic application that uses ID Manual descriptions. Paper filing costs $850 per class and is allowed only in limited circumstances.

How Many Classes Do You Need?

The USPTO sorts goods and services into numbered international classes. Your fee is the per-class fee multiplied by the number of classes you claim, plus any surcharges for each class. Before filing, list what you actually sell or plan to sell under the mark, then find the matching classes in the ID Manual.

Claiming classes you don't use adds cost without adding protection. You also have to show use of the mark in every class you keep, so an overly broad application can create more work later.

Costs If You File Based on Intent to Use

If you file before you start using the mark in commerce, the USPTO can approve the mark and then wait for proof of use. That proof, and any extra time to provide it, carries its own per-class fees.

Intent-to-use and other filings

Item Price
Statement of use (SOU), per class $150
Six-month extension for filing an SOU, per class $125
Petition to revive an application $250

The statement of use costs $150 per class. If you need more time, each six-month extension costs $125 per class. If an application is abandoned because a deadline was missed, a petition to revive it costs $250.

Fees to Keep a Trademark Registered

A registration doesn't last forever on its own. You must file maintenance documents at set intervals, and each one is charged per class.

After registration (per class)

Item Price
Section 8 declaration, per class $325
Section 9 registration renewal, per class $325
Section 15 declaration, per class $250
Combined Section 8 and Section 9 renewal, per class $650

Source: USPTO: Fee schedule

  • A Section 8 declaration confirms that you still use the mark. It costs $325 per class.
  • A Section 9 renewal renews the registration. It costs $325 per class.
  • The combined Section 8 and 9 filing, made together at renewal time, costs $650 per class.
  • A Section 15 declaration is optional and can make the registration "incontestable" on certain grounds. It costs $250 per class.

Missing a maintenance deadline can cancel the registration, so add the dates to your calendar as soon as the mark registers.

Costs Outside the USPTO Fee Schedule

Many applicants pay a trademark attorney or a filing service to search for conflicting marks, choose classes, and respond to USPTO office actions. Those fees are set by the provider, aren't in our data, and vary widely. A clearance search before filing may help you avoid paying for an application that ends up refused.

State trademark registration is a separate, cheaper option that protects a mark only within one state. Each state sets its own fee.

Frequently asked questions

How much does it cost to trademark a name?

A name costs the same as any other mark: $350 per class for an electronic application, plus surcharges if they apply. A name used in two classes pays the fee twice.

Is the trademark fee a one-time payment?

No. You pay the application fee once, but keeping the registration requires maintenance filings, such as the Section 8 declaration and the Section 9 renewal, each charged per class.

Why is my trademark fee higher than the base fee?

Surcharges apply if your application is missing required information or uses a free-form description of goods and services instead of the ID Manual. Each surcharge is charged per class.

Can I file a trademark application on paper?

Only in limited circumstances. Paper filing costs $850 per class, much more than electronic filing.

Do I need a lawyer to get a trademark?

U.S.-based applicants can file on their own, but some applicants, such as those based outside the United States, must use a U.S.-licensed attorney. Attorney fees are separate from USPTO fees.
